2. General conditions for use of the site and services offered

Use of www.editions-midi.com implies full and unreserved acceptance of the general conditions of use set out below. These conditions of use may be changed or added to at any time, and users of www.editions-midi.com are therefore invited to consult them regularly. This site is usually accessible to users at all times. However, interruption for technical maintenance may be decided upon by MIDI which will then make best efforts to inform users, in advance, of the dates and times that work is to be carried out.
www.editions-midi.com site is updated regularly by Jérémie du Chaffaut. In the same way, conditions of use may be changed at any time: they are binding on users, who are invited to refer to them as often as possible to be fully informed of them.

3. Description of the services supplied

The purpose of the www.editions-midi.com site is to supply information relating to all activities of the company.
Midi will make best efforts to provide information on the www.editions-midi.com site which is as accurate as possible. However it will not be liable for omissions, inaccuracies or deficiencies in updates, whether created by them or by third party partners supplying information to them.
All content on the www.editions-midi.com site is given for informational purposes only and may be changed. In addition, information on the www.editions-midi.com site is not exhaustive. It is provided subject to changes having been made since it‘s being placed online, and MIDI will not be liable in relation to prices.

MIDI has title to intellectual property rights or holds user rights for all elements that are accessible on the site, in particular, text, images, graphics, logos, icons and sounds.
Any reproduction, representation, modification, publication or adaptation of all or part of the site elements whatever the means or procedures used is prohibited in the absence of prior written authorization from MIDI.
Any unauthorized exploitation of the site or any whatsoever of its elements will be considered as constituting infringement and be sued pursuant to the provisions of Articles L.335-2 et seq of the Intellectual Property Code.
All designs are original and protected under intellectual property legislation.

6. Limits to liability

MIDI will not be liable for pecuniary and non-pecuniary damage caused to users’ equipment when accessing the www.editions-midi.com site and arising either from use of equipment which does not meet the specifications set out in clause 4 above or the appearance of a bug or incompatibility.
MIDI will also not be liable for non-pecuniary damage (for example loss of market share or loss of opportunity) as a result of using the www.editions-midi.com site.
Interactive areas (with the possibility of asking questions in the contact area) are available to users. MIDI reserves the right to remove all content placed in this area contravening legislation which is applicable in France without prior notice, in particular provisions relating to the protection of data. Where appropriate, MIDI also reserves the right to sue the user for civil and/or criminal liability in particular in the case of racist, harmful, defamatory or pornographic messages whatever the media used (text, photographs etc.)

7. The protection of personal data

In France personal data is protected by law n° 78-87 dated 6 January 1978, law n° 2004-801 dated 6 August 2004, Article L. 226-13 of the Penal Code and the European Directive dated 24 October 1995.
When using the www.editions-midi.com site the following may be collected: the URL of links by which the user has accessed the wwww.editions-midi.com site, the user’s access supplier, the Internet Protocol (IP) address of the user.
At all events, MIDI only collects personal data relating to users for the purposes of some services offered by the www.editions-midi.com site. Users supply this information in full knowledge, in particular as it arises from themselves providing it. Users of the www.editions-midi.com site are therefore informed of whether or not there is an obligation to supply this data.
Pursuant to provisions of Articles 38 et seq of law 78-17 dated 6 January 1978 relating to the protection of personal data, users have the right to access, correct and oppose personal data relating to them by making a written, signed application accompanied by a copy of a proof of identity with the holder’s signature, specifying the address to which reply is to be sent.

The site is not declared to the CNIL, the French National Commission for Data Protection, as it does not collect personal data. Databases are protected by the provisions of the law dated 1 July 1998 transposing Directive 96/9 dated 11 March 1996 relating to the legal protection of databases.

9. Applicable law and attribution of jurisdiction

All disputes relating to use of the www.editions-midi.com site will be subject to French law. Exclusive attribution of jurisdiction will be to the Paris courts having jurisdiction.
